Copyrights, trademarks, service marks, patents, trade secrets and other proprietary rights and laws protect all content and materials available on this Website. Nothing on this Website shall be construed as conferring, by implication, estoppel or otherwise, any license or right to any intellectual property rights (e.g., copyright, patent or trademark) or license to any intellectual property, content, technology, system, process, or related material belonging to Loup or any third party by virtue of it being displayed or made accessible hereon. Except as expressly authorized by Loup, no one may use the Loup Website in any manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which are accessed or received through the Loup Website. Note that any product, process, or technology found at the Loup Website may be the subject of other intellectual property rights reserved by Loup, and may not be licensed hereunder.
Each individual document published by Loup on the World Wide Web may contain additional proprietary notices and copyright information relating exclusively to it.
No part of the Loup Website or any program, product, software, or item constituting a part thereof, including the look or feel of the Loup Website, program, product, software or item, may be reproduced in any form or by any electronic or mechanical means, including the use of information storage and retrieval systems, without the express written permission of Loup. Some jurisdictions do not allow the disclaimer and exclusion of implied warranties, so the above exclusion may not apply to particular parties using the Loup Website.
Use of Services
Any use of the Loup Website must be in accordance with the terms of this Policy and any written agreement between the user and Loup, and in accordance with all federal, state and local laws, ordinances and regulations.
The user agrees to use Loup services for lawful purposes, in compliance with all applicable laws. Loup services are defined as the use of computing, telecommunications, software and information services provided by Loup. These services also include the means of access to computing, telecommunications, software and information services provided via the global Internet.
Loup reserves the right, in its sole discretion, to terminate or temporarily suspend a party's access to the Loup Website, or any portion thereof, at any time, without notice, in the event of the violation by such party of any terms, conditions or notices contained in this Policy.
By completing the registration form required to gain access to the Loup Website, the user acknowledges that it has read and agreed to the terms of this Legal Statement.
Use of Materials
During an investigation, Loup may suspend the account or accounts involved and/or remove the material involved from its servers. If Loup believes a violation of the provisions of this Policy has occurred, it may take responsible action at its sole discretion. Such action may include, but is not limited to, temporary or permanent removal of material from Loup's servers, the cancellation of news group posts, warnings to the user, and the suspension or termination of the account or accounts responsible. Loup reserves the right to terminate an account with or without notice. Loup, at its sole discretion, will determine what action will be taken in response to a violation on a case-by-case basis. Violations of the provisions of this Policy could also subject the customer/visitor to criminal or civil liability.
Loup reserves the right to access and disclose customer/visitor information in compliance with applicable statutes and lawful government requests. This may include disclosing the usernames of customers and other pertinent information. Loup will fully cooperate with law enforcement authorities in investigating suspected lawbreakers and reserves the right to report to law enforcement any suspected illegal activity of which it becomes aware.
The customer/visitor is prohibited from storing, distributing or transmitting any unlawful material through Loup services. Examples of unlawful material include but are not limited to direct threats of physical harm, child pornography, and copyrighted, trademarked and other proprietary material used without proper authorization. The customer is also prohibited from storing, distributing or transmitting any information that may be determined to be of a harassing nature. Further, the customer may not post, upload or otherwise distribute copyrighted material on Loup's servers without the consent of the copyright holder. The storage, distribution, or transmission of unlawful materials could subject the customer to criminal as well as civil liability, in addition to the actions outlined above.
The customer may not store or distribute certain other types of material on Loup's servers. Examples of prohibited material include, but are not limited to, programs containing viruses or trojans and tools to compromise the security of other sites.
Loup accounts are for individual use only. Customers may not share passwords with other individuals and are responsible for maintaining the security of their passwords.
Loup shall provide passwords to customers/visitors. In the event that the security of an account is compromised, Loup shall provide a new password.
Loup staff may monitor the security of customers'/visitors' passwords at any time. A customer with an insecure password may be directed to change the password to one which complies with the above rules. A customer who repeatedly chooses insecure passwords may be assigned a password by Loup; continued failure to maintain password security shall be grounds for immediate account termination.
Loup will allocate system resources to provide all customer/visitors with the best service possible. As part of resource allocation, Loup may limit, restrict or prioritize access to system resources, including CPU time, memory, disk space, session length, and the number of sessions.
Additionally, Loup may institute services and fees for customers/visitors who are interested in accessing system resources above and beyond acceptable usage.
Customers/visitors may not run programs which provide network services from their accounts. Example of prohibited programs include, but are not limited to, Mail, HTTP, IRC servers and multi-user interactive forums.
